1. ABOUT US

These terms apply to every order placed through empirelinenhouse.co.uk and to every quotation we issue.

2. CONSUMERS AND BUSINESSES

Some of what follows depends on whether you are buying as a consumer (as an individual, for purposes outside any business) or as a business (including sole traders, partnerships, limited companies, holiday lets, hotels and serviced accommodation operators).

Consumers have legal rights that cannot be taken away by these terms. Nothing here affects those rights. Where a clause applies only to one type of buyer, we say so.

3. HOW AN ORDER IS MADE

Placing an order through the website is an offer to buy. A contract is formed only when we send you a dispatch confirmation email. If we cannot fulfil your order — for example because an item is out of stock or a price was listed in error — we will tell you and refund any payment in full.

We may decline an order at our discretion, for example where we cannot verify the delivery address or where an order is unusually large for our current stock.

Where we have issued a written quotation, that quotation is valid for 30 days from its date unless it says otherwise, and the specification and prices in it take precedence over the website.

4. PRICES AND VAT

We supply both business and consumer customers. Because most of our customers are VAT-registered businesses who reclaim VAT, our shop leads with the trade figure and shows the VAT-inclusive figure alongside it, so that both kinds of buyer can see what they will actually pay.

Every product page shows the price excluding VAT and the price including VAT at the current rate of 20%. VAT is added to the order total at checkout, and the full VAT amount is itemised before you pay. Consumers should treat the VAT-inclusive figure as the price they will pay.

Delivery charges, where they apply, are shown separately at checkout before you pay. Our delivery thresholds are stated excluding VAT.

Prices may change from time to time, but a change will never affect an order we have already confirmed.

5. PAYMENT

Orders placed through the online shop are paid at checkout by the payment methods offered there. Orders placed against a written quotation are paid by bank transfer to the account shown on the invoice. We do not offer instalments or credit accounts.

Goods remain our property until we have received payment in full. Risk in the goods passes to you on delivery.

7. RETURNS AND CANCELLATIONS

8. DESCRIPTION OF GOODS

-----------------------

Our products are photographed as accurately as we can manage, but screens vary and natural cotton varies slightly between production batches. Small differences in shade, weave and finish between deliveries are normal in textiles and are not a defect. Stated dimensions and weights are subject to the usual manufacturing tolerances.

Cotton shrinks a little on first wash. Care instructions are supplied with the goods and shown on the product pages, and we are not responsible for damage caused by washing or drying outside those instructions.

9. FAULTY GOODS

If goods are faulty, not as described, or not of satisfactory quality, you have legal rights and we will put it right. See the Returns page for how to tell us and what happens next. Nothing in these terms limits your rights under the Consumer Rights Act 2015 if you are a consumer.

10. OUR LIABILITY

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

If you are a consumer: we are responsible for loss you suffer that is a foreseeable result of us breaking these terms, but not for loss that was not foreseeable. We are not liable for business losses.

If you are a business: our total liability in connection with any order is limited to the price paid for that order. We are not liable for loss of profit, loss of business, loss of bookings, loss of goodwill, or any indirect or consequential loss.

11. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by events beyond our reasonable control, including shipping and customs delays, extreme weather, strikes, or supplier failure. If such an event occurs we will contact you and, if the delay is substantial, you may cancel and receive a full refund for anything not yet delivered.

12. OUR WEBSITE

The content of empirelinenhouse.co.uk — text, photographs, product descriptions and logo — belongs to Empire Linen House Ltd and may not be copied or reused without our written permission. Trade customers may use our product photography to sell our products onward, provided the products are represented accurately.

We try to keep the site available at all times but we do not guarantee uninterrupted access.

13. COMPLAINTS

Please email sales@empirelinenhouse.com or call 07375 643 406. We aim to acknowledge every complaint within two working days and resolve it within ten.

14. GENERAL

-----------

We may transfer our rights and obligations under these terms to another business, and we will tell you if we do. You may not transfer yours without our written agreement.

If any part of these terms is found to be unlawful, the rest continues to apply.

We may update these terms. The version that applies to your order is the one published when you placed it.

15. GOVERNING LAW

-----------------

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your own country.
